Ernie’s client (a truck driver) was charged with homicide by vehicle, a serious felony, and involuntary manslaughter. He was able to discover weaknesses in the Commonweath’s case with a creative approach thereby demonstrating that the truck driver was not at fault as the air brakes on the truck were defective. The driver ended up pleading guilty to a Misdemeanor (2nd degree)(M2) and received probation and no jail time.
